Minority Report on Biden’s “Mishandling” of Classified Documents in the U.S. House of Representatives, Chuck Biden, and Jack Smith

On Tuesday they spurned an easy win once again, during testimony before the House Judiciary Committee by Robert Hur, the now-former special counsel who investigated President Biden’s retention of classified documents. Biden broke no laws and Hur would not recommend charges against him, according to the report issued last month. But, of course, the most thrilling part of the report was Hur’s description of Biden’s mental state, calling him a well-meaning elderly man with a poor memory.

In a nearly 350-page report released last month, Hur said charges were not warranted against Biden for his alleged mishandling of classified materials after he left the vice presidency. But that decision was overshadowed by Hur’s description of Biden as a “sympathetic, well-meaning, elderly man with a poor memory.”

Democrats on the committee are likely to use Hur’s appearance to draw a sharp contrast between Biden and Trump, who look set for a rematch in the 2024 presidential race.

The description of Biden was seized on to raise questions about the president’s mental acuity. House Speaker Mike Johnson said that “a man too incapable of being held accountable for mishandling classified information is certainly not suitable for the Oval Office.”

The decision not to charge Biden was claimed by Johnson and his fellow Republicans to be proof that the justice system is two-tiered.

Jack Smith is leading a separate investigation into Trump’s alleged mismanagement of classified documents after he left the presidency. Trump was indicted on over three dozen federal criminal charges for having boxes of classified material at his Mar-a-Lago residence.

Although the Biden and Trump cases both involve classified materials, there are significant differences between them. In Biden’s case, his attorneys promptly returned the records after discovering them. The accused is Trump, who is accused of keeping the classified documents and trying to get them back.

“Unlike the evidence involving Mr. Biden, the allegations set forth in the indictment of Mr. Trump, if proven, would present serious aggravating facts.”

The investigation was led by Reps. Jim Jordan, R-Ohio, and James Comer, R-Kentucky, but they did not produce evidence of Biden’s involvement in any foreign business dealings.

Representative Tom Tiffany of Wisconsin said that Hur was a part of the Praetorian Guard that protects the elites.

Tom McClintock of California used his allotted time to complain about the prosecution of Donald Trump, charging that the Biden administration was using the rule of law as a weapon to wield against political rivals.

With every day of the Trump era, it becomes clear they don’t actually want to win. They don’t care about what’s in those documents. All they care about is their endless list of grievances about the swamp, the “deep state,” the elites — whatever today’s term is for the government that they control half of.
