The case against Mr. Trump is the second criminal prosecution against the former president this year. In April, Mr. Trump was charged with false business records and appeared in a New York courthouse.
According to accusations made in the case, Mr. Trump has been charged with 37 counts of unauthorized retention of national security information. They relate to the former president’s hoarding of sensitive government documents after he left office and his refusal to return them, even after being subpoenaed for all remaining records in his possession that were marked as classified.
The court appearance on Tuesday will likely mark a new era in his political career, as charges against him grow and he mounts a presidential reelection bid in four years.
Trump’s hearing is scheduled for 3 p.m. ET, according to the former president and his lawyers. He will have to give up a lot of services, including booking and processing, before he can appear in court.
Weaver said that the federal courthouse is connected to an underground garage. That tunnel could provide a secure spot for Trump to be electronically finger-printed.
Are there handcuffs and a mugshot? Those steps probably won’t be necessary in this controlled environment with such a high-profile figure, Weaver says. Skipping both of those steps would be consistent with what transpired ahead of his Manhattan arraignment in April.

Trump is scheduled to make remarks at a fundraising event in Bedminster again on Tuesday night. He took a similar tactic after also being arraigned in New York in April, taking to his home turf in Mar-a-Lago in Florida for a campaign speech in which he described himself as an innocent man and political martyr.
It’s unclear which judge will oversee Tuesday’s hearing, but we do know his case has been assigned to Judge Aileen M. Cannon, and it could be the first time the two come face-to-face.
Trump appointed Cannon to the bench in 2020. A special master was put in place to review documents taken from Mar-a-Lago by the FBI. The move temporarily stopped federal prosecutors from continuing their investigation into the documents.
“Especially when he isn’t guilty, Trump won’t seek a plea deal”, said Habba, who is not currently part of the team representing him. “He would never admit guilt.”
Trump’s personal aide, Walt Nauta, has also been summoned to appear in court at the same time. According to federal prosecutors, they charged Nauta with helping Trump hide boxes of classified documents.

“We need strength at this point. The people are afraid to do anything. They’re afraid to talk. They have to go out and protest peacefully,” Trump said in a radio interview hosted by his former advisor, Roger Stone, on Sunday afternoon.

Special counsel Jack Smith, who was appointed by the Justice Department to oversee an independent investigation of Trump, defended the work of his team and the FBI in remarks last week.

There will be motions to dismiss it on the basis of prosecution. “You prosecuted me, but you did not prosecute Hillary Clinton or Joe Biden for the same things.”
Weaver is also expecting delays over the choice of venue (a possible move to West Palm Beach, which could see a jury pool more favorable to Trump) and delays related to the Classified Protection Act (the defense attorney might need a security clearance just to review the records included as evidence).
That means a trial could land right in the thick of Trump’s 2024 presidential campaign — as the former president told Politico this weekend, he’d stump from prison if necessary.
Security at the Wilkie D. Ferguson Jr. federal courthouse was tight Monday, with police and federal law enforcement sweeping the courthouse grounds before former President Donald J. Trump’s appearance.
Mr. Trump was expected to be arrested on Tuesday, but it was unclear whether U.S. marshals would take his fingerprints or photograph him. Those measures are normally used to help identify defendants, but when Mr. Trump was arraigned on unrelated state charges in New York in April, officials felt they were unnecessary given the former president’s level of fame.

The group was recently found guilty of seditious conspiracy. The arrest of more than one thousand of Mr. Trumps’ most extreme supporters in the storming of the Capitol in January 2020 is leaving many of them reeling.
A throng of news media organizations had gathered at the courthouse, setting up tents and crowding the perimeter, but few if any members of the public were in attendance.

Mayor Francis X. Suarez called a news conference to inform anyone who planned to hold a protest that violence was not welcome in the city. Mr. Suarez said he believed in the right to protest but also in “law and order.”
Mr. Suarez said the authorities might close roads near the courthouse depending on the size of any protests, and that commuters should expect possible disruption.
James Trusty and John Rowley were two of the attorneys who represented Mr. Trump in the classified documents investigation.
Mr. Trump said he would be represented in the matter by a new lawyer, Todd Blanche. He will also be represented by Christopher M. Kise, a former solicitor general for the state of Florida who has won four cases before the United States Supreme Court.
The government is expected to be represented by Jay I. Bratt, a top official of the Justice Department’s national security division, and Julie Edelstein, the deputy chief of counterintelligence and export control.
Manny Morales, the Miami police chief, said his force was prepared for a crowd of anywhere from 5,000 to 50,000 protesters. Chief Morales said officers would endeavor to keep any groups of rival protesters away from each other.
“We’re taking this event extremely serious,” he said. “We know that there’s a potential of things taking a turn for the worst. That does not correspond to the way in Miami.

An earlier version described the indictment against former President Donald Trump. He is the first former commander in chief to be federally charged; he is not the first presidential candidate to face federal charges.
Trump claims that he is being unfairly targeted by prosecutors because he’s running for president again. The claims of bias in the Justice Department are being echoed by his Republican allies.
It is not clear whether Trump will be handcuffed, either. He was not when he appeared in court in April in a New York state case about hush money payments made before the 2016 election.
The judge could set certain restrictions as the case proceeds, potentially asking them to turn over passports, limit travel or check in with court supervision.
Extremists say they don’t see large-scale and detailed planning around the courthouse appearance like they did in the leadup to the Capitol riot.
It could take months of delays if Trump makes other motions in the case. The legal team could even try to postpone the trial until after the presidential election.
Trump is making the federal indictment a part of his campaign. He’s even planning to talk Tuesday night at a fundraiser at his golf club in New Jersey.
A special counsel is currently looking into how Biden himself came to have classified documents in his private office and residence. But in that case, there’s no hint Biden is resisting turning over any of the papers, like Trump allegedly did for about a year.
