A judge ruled that the Trump administration should return a man from Central America

A Federal Judge Order to Return a Deported Salvadoran to the U.S. and Abrego Garcia to the El Salvadorn Prisoner’s Case

Murphy’s order adds to a string of findings by federal courts against recent Trump administration deportations. Those have included other deportations to third countries and the erroneous deportation of Kilmar Abrego Garcia, an El Salvadoran who had lived in Maryland for roughly 14 years working and raising a family.

The Supreme Court ruled that the White House couldn’t claim it couldn’t get Abrego back to the US after mistakenly deporting him. White House and El Salvadoran president say they aren’t able to return him. The Trump administration has tried to invoke the state secrets privilege, arguing that releasing details in open court — or even to the judge in private — about returning Abrego Garcia to the United States would jeopardize national security.

A federal judge on Friday ordered the return of a deported man to Mexico despite his fear of being harmed there.

Judge Murphy acknowledged the distinction and the constitutional limitations on the judiciary being able to direct the conduct of the executive branch overseas. He felt that the word “facilitate” should be used less in O.C.G.’s case because he is not held by any foreign government.

The man, who is gay, was protected from being deported to his native country under an order by an immigration judge. He was put on a bus and sent to Mexico, something that Judge Brian Murphy of the U.S. District Judge found likely lacks any semblance of due process.

“No one has ever suggested that O.C.G. poses any sort of security threat,” Murphy wrote. “In general, this case presents no special facts or legal circumstances, only the banal horror of a man being wrongfully loaded onto a bus and sent back to a country where he was allegedly just raped and kidnapped.”

Murphy nodded to the conflict over the word “facilitate” in that case, and said it is not complicated to return O.C.G. to the U.S.
