A High Court Decision in Westlaw’s Fair Use’ Case’ [J. J. Mammen et al
Jeffrey said the ruling was a big deal. The court made a finding that the editorial content of Westlaw’s attorneys is protected by copyright and cannot be used without their consent, he wrote. “The copying of our content was not ‘fair use.’”
Chris Mammen, a partner at Womble Bond Dickinson who focuses on intellectual property law, concurs that this will complicate AI companies’ fair use arguments, although it could vary from plaintiff to plaintiff. He says that it makes a finger on the scale towards holding that fair use doesn’t apply.
Judge Bibas, who wrote the decision on the matter, said that Ross’s fair-use defense didn’t hold water because of the way he used copyrighted material.
We are pleased that the court granted summary judgment in our favor and concluded that Westlaw’s editorial content created and maintained by our attorney editors, is protected by copyright and cannot be used without our consent. The copying of our content was not “fair use.”
