The Search for TikTok is a Dramatic Liferaft: Can China Shut Down the Adversarial Social Media Hit?

According to the court’s unanimous opinion, TikTok is a distinctive and expansive source of community for more than 170 million Americans. Congress has decided that there are well-supported national security concerns regarding TikTok’s data collection practices and relationship with a foreign adversary.

The justices gave their own statements, concurring with the final judgment. She thinks it’s apparent that the law implicates the First Amendment. Even so, she agrees that the law can survive such scrutiny.

But to TikTok executives, that is merely a symbolic life raft, since ByteDance has consistently indicated that the platform, China’s first global social media hit, is not for sale. China does not likely to allow export control laws to stop TikTok’s algorithm from being sold, according to experts.

For more than five years, US government officials have tried to ban or force a sale of TikTok, accusing the Chinese-owned company of sharing American user data with the Chinese government and filling feeds with pro-China propaganda. Congress and agencies like the FBI are not giving the public much information that confirms the allegations, but they have taken a number of different actions to ban TikTok.

“As far as the 2000 ruling goes, it’s not meant to have greater precedential value because it’s a one-off decision, and Bush v. Gore is one-off, and not meant to have greater precedential value,” he said. “But this will be a very important decision,” he said. “And it gives enormous power to Congress to act on data privacy questions.”

Neil Gorsuch was the only justice to speak out about the free speech implications of a ban.

“Do you suppose that counter speech is the best remedy for problematic speech?” said Gorsuch, as he explained that TikTok might possibly include a caution on its app that some of its content may be manipulated by China.

U.S. Solicitor General Elizabeth Prelogar, representing the federal government, quickly shot that down with this analogy: “Imagine if you walked into a store and I had a sign that said one of 1 million products in this store causes cancer,” she told the court. That isn’t going to alert you to what is actually putting your health at risk.

On Friday following the Supreme Court’s ruling, Biden White House press secretary Karine Jean-Pierre said in a statement that it would be up to the incoming administration to implement the law. The administration understands that actions to implement the law need to fall to the next administration which takes office on Monday, she said.

Donald Trump is now the center of attention. He filed a brief with the Supreme Court, asking that they delay a ruling to give him time to negotiate a solution that would resolve national security concerns.

The president is allowed to delay the ban for 90 days in the event that progress on a sale outside ByteDance is made.

On Friday, Trump posted on his social media platform that he has not made a decision yet. “The Supreme Court decision was expected, and everyone must respect it. My decision on TikTok will be made in the not too distant future, but I must have time to review the situation. Stay tuned!”
