That charge of obstruction and conspiracy to defraud the United States in the administration of elections are entirely fitting for the conduct alleged in the indictment. The judge who presided over the civil case against Mr. Trump and John Eastman held that they likely engaged in a criminal conspiracy while trying to get the vice president to vote for them. Mr. Smith said he can prove his conduct beyond a reasonable doubt.
And it works. In March, Trump had 43% of the vote in Republican polling, according to a RealClearPolitics average. His numbers went up to 50% after he was charged with taking money from an adult film actress.
Trump has conditioned his supporters to support him even if there is a reason to believe that he is guilty of a crime.

The special counsel said in a statement before reporters that the attack on the Capitol was an “unprevailing assault” on American democracy. “As described in the indictment, it was fueled by lies. Lies by the defendant, targeted at obstructing a bedrock function of the U.S. government.”
The attacks from Trump and his supporters are focusing on the process not the substance according to Franco Ordoez, an NPR White House correspondent.
The descriptions of the people who could be of interest to investigators include former Trump lawyers Rudy Giuliani, John Eastman, and Sidney Powell, as well as former DOJ attorney Jeffrey Clark.
Attorneys helped promote false election fraud claims. The co-conspirators acknowledged that the election fraud claims were crazy. Another, co-conspirator 4, was a Justice Department official who worked on civil matters and “attempted to use the Justice Department to open sham election crime investigations and influence state legislatures.”
Trump will be standing alone as he appears in court. This is despite the fact that federal prosecutors list six other individuals that they say served as crucial roles in this alleged conspiracy. The six allies were not officially named by the prosecutors.
Following an investigation by special counsel Jack Smith, a grand jury voted to charge Trump with conspiracy to defraud the United States, witness tampering and conspiracy against the rights of citizens, and obstruction of an attempt to obstruct an official proceeding.
Trump, who has been summoned to appear in court on Thursday, is still the leading candidate in the Republican primary race. He will make his case for the White House if he pleads guilty, but we will be keeping an eye on his trial.
Although the Jan. 6 select committee referred Mr. Trump for investigation for inciting an insurrection, Mr. Smith wisely demurred. insurrection has never been charged by the DOJ in any other case related to the attack on the Capitol. Of course, no president has engaged in it since then — but since no one else has been charged with that crime relating to Jan. 6, it likely would have been an issue. And since the penalty for the insurrection offense is that the defendant would not be eligible to hold federal office, it would have fueled a claim of weaponizing the Justice Department to defeat a political rival.
But the indictment does more: It skillfully avoids breathing air into a Trump claim of selective prosecution. To not bring the case against Mr. Trump would be an act of nonprosecution. The Justice Department has already charged and obtained convictions for myriad foot soldiers related to the attack on the Capitol on Jan. 6, 2021, including charging well over 300 people for obstructing the congressional proceedings. The same charge is brought by the special counsel in the indictment, but the leader of the effort to stop the transfer of power is now being charged.
This plan led to a confrontation at the White House on Jan. 3, 2021 when several Justice Department officials told Trump they would resign en masse if Clark was pushed to Rosen’s position.
Powell is an attorney and federal prosecutor who spread lies after the 2020 election that the machines had flipped votes. Powell and Giuliani were sued by a different company.
A special grand jury in Georgia subpoenaed both Giuliani and Eastman for their part in the ongoing investigation into Trump and his associates.
Silverglate and Charles Burnham, Eastman’s other lawyer, “have analyzed Eastman’s conduct meticulously,” Silverglate said. We have checked the applicable laws. And we have concluded he has not committed a crime.”
In June, the State Bar of California opened its case in Los Angeles to stop him from trying to change the outcome of the election.
He was deeply involved in the plan to send alternate slates of pro-Trump electors to Congress. During the January 6 rally, which was attended by Trump supporters, Eastman made comments to the crowd, which caused more voter fraud and criticism of Pence.

“I suppose it’s good news from my point of view that I’m an unindicted co-conspirator rather than an indicted co-conspirator. I hope to be called as a witness to support the president’s defense, because getting legal advice about interpretations of the constitution doesn’t justify a criminal action.
Giuliani said things at the rally. After the 9/11 attacks on New York City, Giuliani was thought of as a hero, but he was an accomplished prosecutor who was famous for the prosecution of the city’s mafia bosses.
The federal indictment says that co-conspirator 1 told the crowd that Vice President Mike Pence could “‘cast the [Electoral Count Act] aside and unilaterally decide on the validity of these crooked ballots.’ ” The indictment said co-conspirator 1 “also lied when he claimed to ‘have letters from five legislatures begging us’ to send elector slates to the legislatures for review, and called for ‘trial by combat.’ “
On Jan. 6, 2021, Trump was set to speak at a rally ahead of the 2020 election being certified in Congress later that day. Giuliani and Eastman spoke before the former president.
Federal prosecutors describe this individual as an “attorney who was willing to spread knowingly false claims and pursue strategies that the defendant’s 2020 re-election campaign would not.”
The New York Times has learned that an attorney for Rudy Giuliani appears to be a co-conspirator. And John Eastman, a former Trump attorney, has said he is co-conspirator 2.
The prosecutors’ choice to keep the names out of the indictment was likely done to make the case simpler and quicker, according to a former federal prosecutor.
A case will take longer to be tried if more people are co-defendants. So there’s obviously some belief and desire to get this case across the finish line in a timely fashion — which if there were six defendants instead of one probably would not happen, of course,” she said.
Time is of the essence in this case. This criminal case comes as Trump is running for president and is contending with a lawsuit and two other criminal cases out of New York and Florida.

“We’ve seen no sign that any of these people, assuming that we’ve identified them correctly, are cooperating or even thinking about cooperating,” she said.
Harvey Silverglate, one of Eastman’s attorneys, told NPR that Eastman’s legal team figured out he is one of the co-conspirators on their own, through details offered in the court documents.
Silverglate said that at no point did federal investigators inform them that Eastman was a target of prosecutors — even after the indictment against Trump was published.
Unindicted co- conspirators don’t need to use their names. Each person is entitled to know if he’s a target of this investigation,” Silverglate said. The Department of Justice has not let us know that he is a target.
Along with Eastman and Giuliani, Powell and Clark served as Trump’s allies and attempted to wield their powers in their respective positions to turn the election in Trump’s favor — an effort that exploded into violence when his supporters attacked the U.S. Capitol on Jan. 6, 2021, according to prosecutors.
