A judge said that West Virginia’s ban on trans school athletes is still valid
A Democrat Appeals for the State Legislature to Protect Transgenders from Playing Cross-Country in the U.S. Senate
The regulations come into force on March 31 and prohibit athletes who have gone through male puberty from participating in female world rankings. The exclusion applied to athletes who have been through male puberty.
The American Civil Liberties Union filed a lawsuit in West Virginia on behalf of an 11-year-old girl who wanted to compete in cross-country. The lawsuit named the state and county boards of education and their superintendents as defendants.
“Decisions are always difficult when they involve conflicting needs and rights between different groups, but we continue to take the view that we must maintain fairness for female athletes above all other considerations,” World Athletics president Sebastian Coe said in a statement.
The legislature’s definition of a girl is based on “biological sex”, which is related to the interest in providing equal athletic opportunities for females.
In his Thursday decision, he said the plaintiff, “like all transgender people, deserves respect and the ability to live free from judgment and hatred for simply being who she is.” But he did not find sufficient evidence that lawmakers passed the legislation with harmful intent.
There were no reports of trans girls playing sports at the time the measure was passed. He said that the statute was at best a solution to a potential, but not yet realized a problem.

Had the legislature not done so, there would have been no reason for the court to weigh in on the issue, he continued. “Nevertheless,” the judge concluded, “I must do so now.”
A survey conducted by the Williams Institute at the UCLA School of Law showed that West Virginia had the highest percentage of residents who identified as trans in the country. That equated to about 1,150 teens.
Mid Vermont Christian School (MVCS) was set to play Long Trail School on February 21, but MVCS forfeited the game due to a transgender player on Long Trail’s roster, according to the head of school at MVCS, Vicky Fogg.
The withdrawal of the tournament was due to the fact that they believed playing against an opponent with a biological male could jeopardize the fairness of the game and the safety of their players.
The factors that go into determining the sex listed on a birth certificate may include anatomy, genetics and hormones, and there is broad natural variation in each of these categories.
The Williams Institute has found that 30% of the people they studied attempted suicide, and that more than half of the people they studied had considered suicide.
Coe said that the decision was taken after consultation with groups including the World athletics member federations, the Global athletics Coaches Academy, and Athletes’ Commission and the IOC.
CNN obtained a document from World Athletics stating that trans women can use their hormones to increase muscle mass, volume and strength over cis women after 12 months.
In Thursday’s statement, World Athletics said: “It became apparent that there was little support within the sport for the option that was first presented to stakeholders, which required transgender athletes to maintain their testosterone levels below 2.5nmol/L for 24 months to be eligible to compete internationally in the female category.”
